Please check below if you wish to designate your purchase as a charitable contribution to BEF, a tax-exempt 501(c)(3) organization.  By doing so, you will be directing BEF to buy the number of Green Tags that you designate and to retire  those Green Tags and their attached emissions credits from use.  If you choose this option,  you will receive a letter from BEF confirming your donation, and you will be able to take a tax deduction.  You will also receive documentation describing  the purchase your donation made possible.   This option is recommended by the UUCUV.

Or, alternatively, you may retain possession of the Green Tags you purchase, allowing you to take personal credit for offsetting the  environmental effects of your electricity use.  If you would prefer to retain ownership of your Green Tags, please read terms and conditions of agreement listed on the reverse of this order form.  By checking below you agree that you have read them and agree to be bound by them.  This option is not tax-deductible.  You will receive certificates describing and memorializing your purchase.

The Bonneville Environmental Foundation's Green Tag Agreement:
Terms and Conditions for Simple Green Tag Retail Purchase

This is an agreement for the purchase of Green Tags. Each Green Tag represents all the environmental attributes associated with the generation of one Megawatt-hour (MWh) of electricity from electric generating facilities approved as sources of environmentally-preferred energy by public interest groups in the Pacific Northwest.

Part 1. The Bonneville Environmental Foundation's Commitment

1. BEF agrees to deliver Green Tags from an endorsed, environmentally-preferred resource in the quantity and over the time period necessary to meet its obligations to the Customer, with the limitations provided in the following paragraph.

2. BEF's delivery of Green Tags is subject to uncertainties, including the availability and intermittent nature of solar and wind energy resources, the number and duration of scheduled and unscheduled maintenance operations, the reliability of the generating technologies, and other factors beyond the control of BEF. In the event that it is unable to meet its delivery obligations from a designated facility within the designated time period, BEF may reconcile its delivery obligations with Green Tags produced from another endorsed, environmentally-preferred resource, at BEF's option, by the end of the first quarter of the following calendar year.

3. BEF agrees to obtain and maintain information necessary to substantiate its acquisition of Green Tags from each endorsed resource, including the description of the resource, the number of Green Tags produced, and the calendar year in which they were produced. This information will be made available to the Customer no less often than annually.

4. BEF agrees that credit for the environmental attributes associated with BEF's Green Tags will pass through to the customers who purchase those Green Tags, and that BEF will not make any claims or reserve any rights with respect to environmental attributes for Green Tags that have been resold to its customers.

5. BEF represents that it will perform due diligence for the Green Tags that it acquires and sells to ensurethat only one Green Tag is issued for each megawatt-hour of electricity generated from an endorsed resource, that each Green Tag is sold only once, and that the electricity generated in association with the Green Tag is sold without any claim or assertion of rights by any other party with respect to any of the environmental attributes associated with the Green Tag, except as otherwise provided by law.  Furthermore, BEF will maintain appropriate chain of custody as each Green Tag is passed intact and without modification from the supplier, through BEF, to BEF's Customer.
 

Part 2. The Customer's Commitment

1. The Customer agrees to purchase Green Tags from BEF in accordance with these terms and conditions.

2. The Customer agrees that the Green Tags are being purchased and used for the purpose of offsetting or mitigating environmental impacts of the customer's energy use, and therefore agrees not to resell or otherwise transfer the Green Tags or any portion thereof to any other party for any purpose.

3. The Customer understands that BEF will undertake to match its purchase and sale of Green Tags within any contract period, but that the timing of BEF's purchase of Green Tags is subject to some uncertainties, including the availability and intermittent nature of solar and wind energy resources, the number and duration of scheduled and unscheduled maintenance operations, the reliability of the generating technologies, and other factors beyond the control of BEF.

4. The Customer acknowledges that BEF is not an electric utility or a provider of electricity; that the purchase of Green Tags is separate and distinct from the purchase of electricity; that Green Tags do not substitute for electricity, and that the Customer still needs to obtain or maintain electricity service from another source.
 

Part 3. The Fine Print

In no event shall either party be liable to the other party for indirect, special, incidental, or consequential damages, including but not limited to the loss of revenues or profits, cost of substitute services, cost of purchased power, loss of opportunity, loss of goodwill, loss of data, governmental sanctions or penalties or claims of third parties, whether such liabilities arise as a result of breach of contract, warranty, indemnity, tort, negligence, strict liability or otherwise; and BEF and the Customer hereby release each other from any such liabilities. This agreement shall be governed by the laws of the State of Oregon. Any dispute under this agreement shall be subject to mandatory arbitration in accordance with the rules of the American Arbitration Association, with the arbitrator's decision binding on all parties.

Part 4. Agreement

The Customer acknowledges that he or she has reviewed the terms and conditions set out above, agrees to be bound by them, and is authorized to enter into this Agreement.
